The following terms and conditions (the "Agreement") administers the use of the Imagine Your Story application through the imagineyourstory.ai website (the "Website") and the associated services (“Services”) advertised and available on or at the Website. The Website is owned and operated by The Story Architects in Hong Kong ("The Story Architects"). The Website is offered subject to your (the "User" or "you") acceptance without modification of any of the terms and conditions contained herein and all other operating rules, policies and procedures that may be modified and published from time to time on the Website by The Story Architects – including, Pricing, Refund, Privacy Policy and others. If you do not agree to this Agreement, please refrain from accessing the Website or using the Services. 

The Story Architects offers a refund policy adhering to the policies mentioned. 

1.    Access & User Information

In order to purchase and use the Services on the Website, the User is required to fill the contact form on the Website (including filling out all required personal information).  

The User must notify The Story Architects immediately of any breach of security or unauthorized use of its account.

The Story Architects may change, suspend or discontinue the Services, Products, fees, charges and terms at any time, including the availability of any feature or content. The Story Architects may also impose limits on certain features and Services or restrict User’s access to parts or all of the Services without notice or liability.

The User certifies to The Story Architects that if the User is an individual (i.e., not a corporation), the User is at least 18 years of age. The User also certifies that it is legally permitted to use the Website, and takes full responsibility for the selection and use of the Website. This Agreement is void where prohibited by law, and the right to access the Website is revoked in such jurisdictions.

If the User provides and uses any personal information which belongs to any other person other than the User, the User covenants and undertakes to The Story Architects that all and any of such personal information are obtained by the User and provided to The Story Architects with express consent of the data subject and that such data subject has given express consent to the User and The Story Architects to use such personal information by The Story Architects subject to the terms herein. 

2.    Intellectual Property Rights

The Story Architects is the owner or the licensee of all intellectual property rights used on the Website or through the Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Website (collectively, the “Content”) and the trademarks, service marks, and logos contained therein, in particular, the brand name “Imagine Your Story” (the “Marks”), and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws and treaties around the world. All such rights are reserved.

The Content and the Marks are provided on the Website “AS IS” for your information and personal use only. Except as expressly provided in this Agreement, no part of the Website and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Any information or data provided by or through the User for the use of the Services belongs to the User or the data subject in concern.  The User grants or must procure the data subject to grant The Story Architects an irrevocable, unconditional and free licence to use such information or data for The Story Architects to provide the Services. 

3.    Representations and Disclaimers

By using the Website or the Services, you represents and warrants that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with the terms in this Agreement; (4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Website; (5) you will not access nor conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Website or any services provided via, or in relation to, the Website or the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Website or the Services for any illegal or unauthorised purpose; and (7) your use of the Website or Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Website (or any portion thereof).

We are a service provider and make no representations as to the safety, effectiveness, adequacy, accuracy, availability, prices, ratings, reviews, or legality of any of the information contained on the Website or the Services offered through the Website.

The Story Architects expressly disclaims any liability arising from or out of the use of any products or outcome provided through the Services by the User as The Story Architects has in any way NO control of the information or data provided by the User.  We make no representations, warranties or guarantees, whether express or implied, that the products or outcome provided through the Services are accurate, complete or up to date.  We do not carry out independent verifications on any information supplied by the User through the Website and no one shall rely on the products or outcome provided through the Services, whether the User or any third party.

4.    Third Party Providers

The AI Feature is provided by third-parties providers. Currently we are using artificial intelligence technology developed and provided by OpenAI LLC (“OpenAI”). User acknowledges and understands that by using the AI Feature the OpenAI Terms of Service, which govern the use of the AI Feature and specifically, that any information, content or code uploaded to the AI Feature (“Input”) may, depending on the type of API, be used by OpenAI for model training and improvement. The Input may be shared with and manually reviewed by a person, including by third party contractors located around the world. The User should not use or provide any information that is sensitive or that he does not want others to view, including personal data. The Story Architects has no control over the use of the Input, thus, any use of such is at The User’s own risk and The Story Architects does not represent, undertake or warrant to any security or control of or to the Input.

5.    Content of the AI Feature

The User is solely responsible for the Input. Further, by using the AI Feature, the User will receive output generated and returned by the AI Feature based on the Input (“Output”) (Input and Output are collectively “Content”). The User is solely responsible for ensuring that the Content complies with applicable laws, these AI Terms, and specifically the AUP requirements set forth in the “Accuracy of Output generated by the AI Feature” section below. As between the parties and to the extent permitted by OpenAI Terms and applicable law, the User owns all Input and is hereby granted rights, title and interests in and to the Output. The Content may be used for any legal and lawful purpose, including commercial purposes and publication, at User’s own risk. Prior to publication, it is recommended that the User adds a disclosure to the Output that was generated by AI tools. Due to the nature of machine learning, Output may not be unique across users and the AI Feature may generate the same or similar output for third parties.

6.    Accuracy of Output generated by the AI Feature

The User acknowledges that the AI Feature is provided by third party providers. The Story Architects does not guarantee accuracy of any Output generated by the AI Feature. Given the probabilistic nature of machine learning, and AI, use of our AI Feature may in some situations result in incorrect Output that does not accurately reflect the action generated by the User. The User shall evaluate the accuracy of any Output and acknowledges that The Story Architects is not responsible nor obligated to verify the same.

7.    Acceptable Use Policy of the AI Feature

The User hereby represent and warrant that it will not, nor will it authorize anyone on its behalf, including an authorized User, to: (a) mislead anyone that the Content generated is human-generated; (b) use the AI Feature to generate content that expresses or promotes hate, harassment, or violence, exploits or harms children, encourages self-harm, presents illegal, sexual, political, harmful, false, deceiving or misleading information, misuses personal data, contains malware, unsolicited bulk content, ransomware, viruses, or other software; (c) use the AI Feature for activities which has high risk of economic harm, for adult content, adult industries, and dating apps; offering tailored financial advice without a qualified person reviewing the information; to provide health advice, political campaigning or lobbying; (d) use the AI Feature in a way that infringes, misappropriates or violates any third party rights; (e) reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the AI Feature (except to the extent such restrictions are contrary to applicable law); (f) use the AI Feature to develop foundation models or other large scale models that compete with The Story Architects or OpenAI; and (g) use any method to extract data from the AI Feature, including web scraping, web harvesting, or web data extraction methods, other than as permitted through the API.

8.    Modifications

The Story Architects reserves the right, at its discretion, to modify this Agreement, fees, charges and terms at any time. The User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Website by the User following such notification constitutes the User's acceptance of the changes in the terms and conditions.

9.    Payments and Fees

The Story Architects may save User’s credit or debit card information to facilitate the Services, unless the User notifies The Story Architects otherwise through an email to hello@imagineyourstory.ai

By accepting this Agreement, the User is confirming that it is legally entitled to use the means of payment tendered and, in the case of card payments, that the User is either the cardholder or have the cardholder's express permission to utilize the card to effect payment. The Story Architects may refuse to process a transaction for any reason or refuse Service to anyone at any time at The Story Architect’s sole discretion. The Story Architects will not be liable to User or any third party by reason of refusing or suspending any transaction after processing has begun.

Unless stated otherwise, all fees and payments are quoted in the U.S. Dollars. The User is responsible for paying all fees, payments and applicable taxes associated with our Website and Services.

10. Online Payment Security

The Story Architects uses the secure Payment Gateway for its online credit card transactions.  The Story Architects does not possess or retain the User’s payment details unless otherwise stated in this Agreement.  All online credit card transactions performed on this site are secured payments. Payments are fully automated with an immediate response.

Your complete credit card number cannot be viewed by The Story Architects or any outside party.

 11. Refund Policy 

If you are not completely satisfied with your purchase for a valid reason, you may initiate a refund for the purchase. Please see below for more information on our refund policy. Refunds are generally not allowed after the Services have transpired unless at the discretion of The Story Architects.

After inspection, we will process your refund. Please allow at least five (5) days from the receipt of your purchase to process your refund. Refunds may take up to 10 days to appear on your credit card statement, depending on your credit card company. We will notify you by email when your refund has been processed.

12. Term and Termination

This Agreement shall remain in full force and effect while you use the Website and the Services. Without limiting any other provision of this agreement, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the website and the services (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in this agreement or of any applicable law or regulation.  We may terminate your use of the website or delete your account and any content or information that you supplied at any time, without warning, in our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

13. Electronic Communications, Transactions and Signatures

Visiting the Website, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Website, satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the Website. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means. 

14.  General

No agency, partnership, joint venture, employee-employer, relationship, etc. is intended or created by this Agreement. You acknowledge that you have all the necessary permits to grant us with User’s personal data to fulfil this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement upon notice to you. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee that we will take action against all breaches of this Agreement. 

15.  Limitation of Liability

In no event will The Story Architects, its founder(s) or our management, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Website or the Services, even if we have been advised of the possibility of such damages.  To the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the lesser of the amount paid, if any, by you to us during the twelve (12) months period prior to any cause of action arising or USD100.

The provisions of this Agreement are intended to bind between The Story Architects and the registered User only and are not intended to and do not create rights in any other person or confer upon any other person any benefits, rights or remedies, and no person is or is intended to be a third party beneficiary of any of the provisions of this Agreement.  The Story Architects expressly disclaims any third party’s rights against The Story Architects for its reliance upon the products or outcome generated from the Services used by a User.

16.  Governing Law and Dispute Resolution

 This Agreement shall be governed by and defined following the laws of Hong Kong.

The Story Architects and yourself irrevocably consent that the courts of Hong Kong which shall have exclusive jurisdiction to resolve any dispute which may arise in connection with this Agreement.
